Terms & Conditions

Important Notice: By accessing or using this Site, you agree to these Terms & Conditions (the “Terms”). If you do not agree, do not use the Site.

1. About B-PEP and Scope of These Terms

1.1 About Us. B-PEP is a nonprofit, nonpartisan civic organization based in Pittsburgh, Pennsylvania, dedicated to political empowerment, education, and equity.

1.2 Contractual Agreement. These Terms form a binding agreement between you and B-PEP governing your use of our Site and Services.

1.3 Incorporated Policies. Your use is also governed by our:

  • Privacy Policy

  • Donor Privacy Policy

  • Media Release Policy

  • Program and Event Rules

These policies are incorporated herein by reference.

2. Eligibility and Accounts

2.1 Eligibility. You must be at least 13 years old to use the Site. If under 18, you may do so only with parental or guardian consent.

2.2 Account Registration. Some features require account registration. You must provide accurate information and maintain confidentiality of your credentials.

2.3 Termination. We may suspend or terminate access for violations or misuse without prior notice.

 

3. Acceptable Use and Prohibited Conduct

You agree not to:

  • Use the Site for illegal, commercial, or fraudulent purposes.

  • Post unlawful, threatening, defamatory, or discriminatory material.

  • Upload malware or attempt unauthorized access.

  • Impersonate any individual or misrepresent affiliation.

  • Copy, frame, or reverse-engineer any portion of the Site.

  • Send spam or unauthorized solicitations.

 

4. User Content and License

4.1 User Content License. You grant B-PEP a nonexclusive, worldwide, royalty-free license to use, reproduce, distribute, and display any content you submit for mission-related purposes.

4.2 Moderation Rights. We may monitor, edit, or remove any material at our discretion.

4.3 Feedback. Suggestions or feedback may be used freely without compensation.

 

5. Intellectual Property

All B-PEP names, marks, and materials—including the “Black Political Empowerment Project” name and logo—are proprietary and protected by U.S. and international law.

You are granted a limited, revocable, nontransferable license to access and use the Site solely for lawful, nonprofit, informational purposes.

 

6. Donations, Payments, and Refunds

6.1 Third-Party Processors. Payments are processed via Zeffy, PayPal, or other approved platforms. Their terms also apply.

6.2 Recurring Gifts. You may cancel recurring donations with at least three (3) business days’ notice before the next scheduled charge.

6.3 Refunds. Unless otherwise stated, donations are nonrefundable. Event tickets or merchandise are subject to posted refund rules.

6.4 Donor Privacy Policy. B-PEP respects donor confidentiality and will not sell, trade, or share donor information without consent. The Donor Privacy Policy explains these protections in full.

 

7. Events, Programs, and Media Releases

7.1 Registration. Events and programs are governed by individual registration terms.

7.2 Media Consent. Attendance constitutes consent to photo, video, or audio recording and use for educational, archival, or promotional purposes by B-PEP.

7.3 Risk and Liability. Participants assume all ordinary risks associated with events.

 

8. Volunteer and Vendor Portal Terms

8.1 Volunteers. Registered volunteers must comply with B-PEP codes of conduct, confidentiality policies, and background check requirements (where applicable).

8.2 Vendors and Partners. Vendors accessing the Site must comply with all contract terms, nondisclosure provisions, and applicable laws. Access does not constitute an employment or agency relationship.

8.3 Termination. B-PEP may revoke volunteer or vendor portal access at any time.

 

9. Third-Party Links

The Site may contain links to independent websites (e.g., news sources, campaigns, event hosts). B-PEP does not control or endorse their content or policies.

 

10. Electronic Communications and SMS

You consent to receive communications electronically.
For text messaging, you may opt out by replying STOP at any time. Standard carrier rates apply.

 

11. Privacy and Cookies

Use of the Site constitutes consent to our Privacy Policy, which explains data collection and cookies. You may disable cookies, though this may limit functionality.

 

12. Accessibility

B-PEP strives for accessibility in compliance with Section 508 and WCAG standards. For assistance, please email accessibility@b—pep.org.

 

13. Disclaimers

The Site is provided “AS IS” without warranties of any kind. We make no guarantees of availability, accuracy, or error-free operation.

 

14. Limitation of Liability

To the fullest extent permitted by law, B-PEP shall not be liable for any indirect, incidental, or consequential damages arising out of Site use.
Total liability shall not exceed $100 or the amount you paid to B-PEP in the previous twelve (12) months, whichever is greater.

 

15. Indemnification

You agree to defend and indemnify B-PEP, its board, officers, and employees from all claims arising out of your use of the Site or violation of these Terms.

 

16. Copyright and DMCA

If you believe your copyright has been infringed, send a notice to:

17. Political and Educational Disclaimer

Content is for educational and advocacy purposes only. References to public officials or candidates do not imply endorsement unless expressly stated.

 

18. Compliance with Pennsylvania Law

The Site operates under the laws of the Commonwealth of Pennsylvania. Users must comply with all applicable state and federal laws, including charitable solicitation laws.

 

19. Governing Law and Venue

This Agreement is governed by Pennsylvania law.
All disputes shall be resolved in the Court of Common Pleas of Allegheny County or the U.S. District Court for the Western District of Pennsylvania, unless otherwise provided under Section 20 (Arbitration).

 

20. Arbitration, Jury Waiver, and Class Action Waiver

20.1 Arbitration Agreement. Except for small claims, any dispute arising out of these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA) in Pittsburgh, PA.

20.2 Waiver of Jury Trial. You waive your right to a trial by jury in any proceeding related to this Agreement.

20.3 Class Action Waiver. You agree that disputes will be resolved on an individual basis only—not as part of any class, collective, or representative action.

20.4 Opt-Out. You may opt out of arbitration by sending written notice within 30 days of first use of the Site to:

21. Suspension, Updates, and Termination

We may suspend or modify Site access, features, or Terms at any time. Continued use after updates constitutes acceptance of the new Terms.
